1. Nature of Our Software

ViraPlayer, developed and published by Wust Creative LLC, is a general-purpose media player application. It functions as a user interface (UI) tool that plays media files and user-provided media sources on the user's own device.

ViraPlayer is functionally equivalent to other general-purpose media players available on the market. It provides playback capabilities for media files and sources that the user independently supplies.

2. DMCA Safe Harbor Notice

Wust Creative LLC operates in compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. As we do not host, store, cache, or transmit any third-party content on our servers, we do not fall within the traditional scope of a "service provider" hosting infringing material. Our servers contain only:

• User account data: Email addresses and device identifiers for license management.
• License records: Activation keys and subscription status.
• Encrypted sync data: End-to-end encrypted user configurations and application preferences (Zero-Knowledge Architecture). All user-provided metadata is encrypted locally. Our servers function solely as blind data relays and cannot read, decrypt, or identify any synchronized information.

No copyrighted content, media files, media URLs, channel listings, or content metadata is stored on our infrastructure at any time.

3. Designated DMCA Agent

Despite the above, if you believe that content accessible through ViraPlayer infringes your copyright, you may submit a notification to our designated DMCA agent. Please note that we can only act on matters within our control (such as removing a user account that has been verified to engage in infringement).

4. DMCA Notification Requirements

A valid DMCA takedown notification must include:

1. A physical or electronic signature of the copyright owner or authorized agent.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing and its location.
4. Your contact information (address, phone number, and email).
5. A statement that you have a good faith belief that the use is not authorized by the copyright owner.
6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

5. User Responsibility

Users of ViraPlayer are solely responsible for ensuring that any media content they access through the application is obtained and used in compliance with applicable copyright laws and regulations. Wust Creative LLC does not monitor, control, or endorse any content that users choose to play through the application. Misuse of the software for accessing unauthorized content is a violation of our Terms of Service and may result in account termination.

6. Counter-Notification

If you believe that material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our DMCA Agent. The counter-notification must comply with the requirements of 17 U.S.C. § 512(g)(3) and include your consent to the jurisdiction of the Federal District Court for the District of Wyoming.

7. Repeat Infringer Policy

In accordance with the DMCA, Wust Creative LLC maintains a policy of terminating the accounts of users who are determined to be repeat infringers of copyrighted material.
